Ted is an accomplished trial lawyer and lead partner in Michael Best’s Litigation practice group. An outstanding business litigator, Ted has tried and argued complex, non-routine commercial disputes throughout Wisconsin and the United States. He has established a proven track record of delivering exceptional results for clients on their most challenging, high-value matters.

Ted has successfully litigated a broad range of matters, including:

Ted also regularly negotiates, prepares and implements business agreements such as construction contract documents, sales agreements, executive separation agreements, licensing agreements and settlement agreements for a diverse group of clients.

Experience

Precedent-setting matters have included:

  • Defending a national sports association in a lawsuit in New Jersey, in which the New Jersey Appellate Division affirmed the broad discretion provided to private membership associations with respect to internal member disciplinary matters
  • Prosecuting contract and tort claims against a municipality and its private contractors in which the Wisconsin Supreme Court clarified the narrow scope of the governmental immunity afforded to private contractors
  • A consumer protection lawsuit in which the Wisconsin Supreme Court clarified the scope and application of common law defenses to statutory causes of action
  • Representing an international manufacturer in the State of Michigan Court of Appeals in a unique and novel U.C.C. dispute in which the Appeals court affirmed the dismissal of the plaintiff’s claims
  • Member of a select team of attorneys who successfully defended a health maintenance organization in a lawsuit brought by one of the largest health care providers in the Midwest. Provider sought millions of dollars in alleged damages under Wisconsin’s health-care cost reimbursement program.
  • Successfully representing a diocese of an organized religion in a property dispute against one of its local parishes that involved issues of first impression in Wisconsin
  • Defending a national hardware store chain in a week-and-a-half long jury trial involving a seven-figure damage claim in which the jury returned a verdict in favor of his client, awarding plaintiffs zero damages on multiple tort claims. The jury verdict established a significant positive precedent for the defendant and its cooperative members.
  • Prosecuting a claim on behalf of a real estate developer, utilizing a creative strategy and legal arguments to defeat numerous motions by the insurers of various contractors seeking an immediate court order declaring that insurance coverage was unavailable to satisfy client claims. Ted’s team was able to negotiate a favorable settlement for their client with the insurers.
