Overview

Stephen has more than 30 years of experience advising and advocating for clients in intellectual property and litigation matters. He focuses his practice on generating successful results in trademark, unfair competition, patent, trade secret, and advertising disputes across the country.

In addition, Stephen manages national product clearance programs and U.S. and global trademark portfolios, and advises clients on a host of brand protection, competition, trademark, advertising, and promotion issues. He has established a successful record of protecting, managing, and defending his clients’ valuable IP assets worldwide.

Before joining the firm, Stephen was an intellectual property litigation partner of a national law firm for many years and spent more than 10 years in-house as trial and IP counsel for May Department Stores Company, now merged with Macy’s.

Experience

Representative matters include:

  • Obtained dismissal of trademark, patent and unfair competition claims brought by client’s competitor, which postured a major dispute for a very favorable settlement.
  • Obtained a favorable defense judgement for multiple footwear manufacturing clients defending a "bet the company" patent action at the International Trade Commission.
  • Successfully defended and resolved dozens of multi-million dollar trademark, trade dress, and design patent injunction claims for a major international footwear retailer.
  • Obtained a favorable jury verdict for a national department store retailer against competitor’s unfair competition claims.
  • Represented an apparel company in design patent and trademark actions, securing a dismissal of principal claims.
  • Obtained court order denying injunction sought in trade secret and infringement action, effectively resolving the dispute in client's favor.
  • Defended a large national retailer and favorably resolved several class action suits brought on various grounds.
  • Successfully defended multi-million dollar injunction actions, confirming rights of a national retailer to build department stores over competitor’s and developer’s objections.
  • Obtained favorable judgment in defense of multi-million dollar deceptive advertising case for a major national retailer.
  • Successfully compelled the surrender or transfer of infringing marks and domain names
