Michelle L. Dama



Clients turn to Michelle for her experience litigating commercial and intellectual property disputes, among other matters. Michelle also serves as a member of the firm’s Higher Education Industry Group, and the firm's Class Action/Multidistrict Litigation team. She tries cases in both federal and state courts at the trial and appellate levels.

Michelle assists a diverse group of clients, many of them long-standing, in the following areas:

  • Complex commercial disputes
  • Intellectual property and trademark litigation
  • Consumer law, including:
    • Telephone Consumer Protection Act (TCPA) of 1991
    • Fair Debt Collection Practices Act (FDCPA)
    • Fair Credit Reporting Act (FCRA)
  • Privacy & Cybersecurity litigation and consulting
  • Product liability actions

Prior to joining the firm, Michelle was a member of the litigation team in the Chicago office at the international firm Jones Day, where she represented several Fortune 500 companies. She also interned with the Honorable Justice N. Patrick Crooks of the Wisconsin Supreme Court.


Representative matters include: 

  • Attained a jury verdict in favor of plaintiff client in a dispute regarding a false marking case related to a design patent 
  • Successfully handled both prosecution and defense of numerous trademark infringement claims on behalf of corporate clients 
  • Represented a leading pharmaceutical company in connection with nationwide personal injury lawsuits
  • Defended a pharmaceutical company in a multidistrict litigation that alleged improper pricing practices under the Medicare, Medicaid, and private insurance reimbursement systems
  • Coordinating defenses of corporate clients on a regular basis against TCPA, FCRA, and FDCPA claims both on individual consumer and class action bases
  • Advise clients on privacy and data protection including issues relating to TCPA, FCRA, GDPR, and CAN-SPAM Act.
  • Represented tire manufacturer in investigations by state Attorneys General following a nationwide recall of tires allegedly involved in sport utility vehicle rollovers
  • Successfully defended a paint manufacturer in national litigation of claims arising from prior manufacture and sale of lead-based paints 
  • Settling numerous and varied defenses of consumer and employment class actions, involving product liability, securities, and employment discrimination.
