Overview

Clients turn to Melanie to develop strategies for resolving intellectual property disputes both inside and outside of the courtroom. Whether patents, trademarks, trade dress, trade secrets, or unfair competition, Melanie helps clients enforce their intellectual property assets and defend against infringement allegations. Drawing on her engineering background, she also counsels clients on pre-litigation patent infringement and validity opinion matters.

Prior to becoming a lawyer, Melanie worked as a process engineer and manufacturing team manager for Procter & Gamble. 

Experience

Notable matters include:

  • Successfully defended generator manufacturer against patent infringement allegations in the U.S. District Court for the Eastern District of Wisconsin; judgment of patent invalidity and noninfringement affirmed by the U.S. Court of Appeals for the Federal Circuit
  • Successfully defended power tool manufacturer against patent infringement claims, obtaining a favorable jury verdict of patent invalidity and noninfringement in the U.S. District Court for the Central District of California; judgment affirmed by the U.S. Court of Appeals for the Federal Circuit
  • Secured favorable settlement in lawsuit enforcing commercial refrigeration manufacturer’s patent in the U.S. District Court for the Western District of Wisconsin
  • Secured favorable settlement with a non-practicing entity claiming patent infringement by power tool manufacturer, in the U.S. District Court for the Southern District of California
  • Successfully defended motor manufacturer against allegations of trade secret misappropriation and unjust enrichment, obtaining partial summary judgment and dismissal prior to trial in the U.S. District Court for the Eastern District of Wisconsin; judgment affirmed by the U.S. Court of Appeals for the Seventh Circuit
  • Secured favorable settlement in lawsuit defending leisure goods manufacturer against allegations of unfair competition and misappropriation of style of doing business in the U.S. District Court for the Eastern District of Wisconsin
  • Secured favorable settlement through mediation of patent infringement claim directed at client’s misting devices in the U.S. District Court for the District of Arizona
