Overview

Kathy’s clients look to her for intelligent and practical advice, prompt and clear communication, excellent trial and oral advocacy skills, and adherence to budget requirements.

Her practice focuses on patent and trademark litigation, as well as litigation related to unfair trade practices and false advertising. Representing both plaintiffs and defendants in these cases, she advises them on enforcing intellectual property rights as well as defending claims brought by IP owners. 

Her patent litigation practice covers a wide variety of technical areas, including mechanical and chemical engineering, biotechnology, and design patents. Kathy has successfully represented well-known companies including Harley-Davidson Motor Co., Mattel, Robert Bosch LLC, Stoughton Trailers, and Kohler Co. in intellectual property cases.

Experience

Kathy has litigated patent and trademark cases in federal district courts across the country and has argued before the Courts of Appeals for the Federal, Fifth, and Seventh Circuits. She has litigated trademark cases related to goods as diverse as motorcycles, dolls, clothes, and golf balls.

Representative engagements include:

  • Patent litigation in the U.S. District Court for the District of Colorado involving patents related to systems used to attach structures to roofs
  • Patent litigation in the U.S. District Court for the Eastern District of Wisconsin (Milwaukee Division) related to networked power generators
  • Patent litigation in the U.S. District Court for the Eastern District of Michigan related to vehicle brake light systems
  • Trademark litigation in the U.S. District Court for the Eastern District of Wisconsin (Milwaukee Division) related to insect repellents on behalf of a large public company
  • Trademark litigation in numerous venues related to famous marks owned by a leading motorcycle manufacturer
  • Patent litigation in the U.S. District Court for the Eastern District of Wisconsin (Milwaukee Division) on behalf of a prominent company in the backyard play set market
  • Prevailing oral argument in the U.S. Court of Appeals for the 5th Circuit in a case involving Lanham Act claims as well as contract and fiduciary duty claims
  • Prevailing oral argument in the U.S. Court of Appeals for the Federal Circuit in a patent case on behalf of a Fortune 500 company
  • Design Patent litigation in the U.S. District Court for the District of South Carolina on behalf of a national neon sign manufacturer
  • Patent litigation in the U.S. District Court for the Eastern District of Wisconsin (Green Bay Division) on behalf of multiple defendants in the LED flashlight industry
  • Trademark litigation in multiple venues on behalf of a major mattress manufacturer

Before joining the firm, Kathy clerked for the Honorable Willis P. Whichard on the North Carolina Supreme Court.
