Overview

Gilberto is a persuasive and effective advocate for clients seeking to protect their intellectual property assets. Focusing his practice on patent litigation at both the trial and appellate levels, he is actively involved in all phases of litigation and trial.

He has built an enviable track record by successfully challenging patents in inter partes review (IPR) proceedings at the Patent Trial and Appeal Board and by fighting off patent infringement suits. Gilberto is also experienced in handling litigation stemming from issues related to unfair competition, false advertising, and trade secrets. In addition to his work as a litigator, he regularly counsels clients on patentability, patent infringement, patent validity, and patent clearance matters.

 

Gilberto’s training as a chemical engineer supports his thorough and ready understanding of the technologies at issue in patent matters. Clients involved in patent validity challenges appreciate his meticulous attention to detail in crafting solutions that combine creative research into invalidating prior art with an intimate knowledge of the statutes, rules, and practices governing increasingly popular America Invents Act (AIA) proceedings.

Experience

Gilberto’s experience includes:

  • Successfully handling inter partes review proceedings and appeals from final written decisions that have dealt with issues of first impression, such as whether the doctrine of assignor estoppel applies to AIA trial proceedings and the scope of the statutory estoppels.
  • Counsel for plaintiff on patents relating to refrigerator shelving. Judgment for plaintiff was affirmed.
  • Counsel for plaintiff on patents relating to refrigerator shelving. Jury verdict of infringement.
  • Counsel for defendant on a design patent for golf putting simulator. Judgment on the pleadings of no infringement.
  • Counsel for defendant in patent infringement action involving fiber replacement ingredient. Summary judgment of no infringement.
