Overview

Evan Strassberg is a seasoned litigator and trial attorney with nearly 25 years of professional experience.  He represents institutional and individual clients in high-stakes and often complex litigation in state and federal courts, as well as in arbitration proceedings. Evan has represented clients in courts all over the country and is an actively licensed member of the Utah and California bars. He has handled a wide variety of matters but has expertise in claims involving breach of contract, fraud, breach of fiduciary duty, and violations of state and federal securities laws.

Evan prides himself on his hands-on approach to his clients’ cases and his pragmatic approach to every case. Over the course of his career, he has practiced in firms ranging in size from two attorneys to 2,000 attorneys. Evan also spent more than three years as in-house counsel for a highly successful Utah-based company where he advised the company on a variety of matters and managed a global trademark portfolio.

Evan proudly serves the Utah legal community as Chair of the Utah Supreme Court’s Advisory Committee on the Rules of Business and Chancery Court Procedure, and as a member and past-Chair of both the Utah State Bar’s Admissions Committee and Character and Fitness Committee. He also serves as President of the Board of Directors of Women of the World, a nonprofit organization based in Utah that helps forcibly displaced women from across the globe in their efforts to obtain economic independence. In the Spring of 2022, Evan taught a class of his own creation, entitled “AI and the Law,” at the SJ Quinney College of Law in Salt Lake City. He plans to teach again in the Fall of 2024.

Evan’s recent client successes include the following representative matters:

  • Obtained summary judgment ruling dismissing the client — the developer and operator of several high-end hotel properties — from a lawsuit alleging fraud in connection with an investment opportunity. The court found an absence of evidence that any false information was conveyed in connection with the transaction. The plaintiffs were seeking damages over $2 million.
  • Obtained a jury verdict awarding the client more than $5 million in damages in a case alleging serious omissions of material fact in a business acquisition. Served as lead counsel in the trial, examining all but one witness, and delivering opening and closing arguments. 
  • Obtained summary judgment in a case in which a long-time client was accused of misrepresenting certain terms of a commercial equipment lease and improperly accounting for payments made under the lease. After two years of contentious litigation, the court found the plaintiff’s claims and arguments were meritless and foreclosed by the language of the lease agreements. The plaintiffs had sought nearly $1 million dollars in adjustments to the amounts owing under the contract. The client not only had its position on what it was owed fully vindicated but was also awarded the attorneys’ fees incurred in defending the action.
  • Prevailed in the trial court and on appeal to the Utah Supreme Court in a high-profile case in which a city challenged the constitutionality of the Utah State Legislature’s creation of a government-run corporation of logistics and distribution.
  • Following an 11-day arbitration before a three-arbitrator panel, the clients were completely vindicated in claims of fraud and breach of fiduciary duty wherein the plaintiffs sought more than $20 million in damages. The plaintiffs claimed that a partnership had been formed with the clients in the development of a high-end residential community in Utah County. The arbitration panel unanimously rejected the plaintiffs’ claims and arguments and awarded the clients seven figures on certain outstanding loans, as well as attorneys’ fees and costs. More than 25 witnesses, including nine experts, testified during the hearing.
