Overview

Al works with manufacturers that are developing products such as vacuum cleaners, power tools, heat exchangers, and lighting equipment and controls. These clients rely on Al for his quick work and novel approach in managing cost-effective patent portfolios and prosecuting patent applications, both internationally and at the U.S. Patent and Trademark Office (USPTO). He also brings excellent advice and good judgment to bear during the product development stage to avoid infringement of competitors’ patents.

Al’s experience keeps him at the cutting edge of patent law and enables him to update clients on new developments to the U.S. patent system. Al also speaks and writes frequently on IP issues. His “Entrepreneur’s Guide to Intellectual Property” was featured in the Wisconsin Technology Network News.

Prior to joining Michael Best, Al worked as an engineer for We Energies, where he focused on mining and transportation of fossil fuels, and construction of underground utilities.

Overcoming Adverse Decisions

When the USPTO decided that a power tool client’s patent application for a major product was “obvious,” Al successfully appealed the decision before the Patent Trial and Appeal Board to obtain allowance of the client’s patent.

Acquisition and Management of Competitor’s Patent Portfolio

In working to draft and secure patents for a client in the air purifier/vacuum cleaner industry, Al facilitated the acquisition of the patent assets of one of the client’s competitors. This provided the client valuable intellectual property assets, and helped the client avoid infringement of the competitor’s patents. When another competitor challenged the validity of the client’s patents, Al assembled a team within Michael Best and successfully defended the client’s patents before the Patent Trial and Appeal Board.

Advising on Product Development to Avoid Infringement

When working with a power tool company during the development and launch of a new product line for a major retailer, Al advised the client on a competitor’s patents, helping the client to avoid infringement for products sold at the same and similar retailers. As a result, the client avoided infringement issues and now has substantial shelf space at a major retailer.
