Trade secrets lawsuits are on a precipitous rise, and that could be bad news for tech startups, life sciences concerns and the entrepreneurial ecosystem in general because of the cost associated in fighting or defending federal lawsuits.
One industry that is not complaining from this rise in trade secrets cases is of course the obvious one: legal.
“I’ve had more trade secrets cases in the past five years than in the past 10 years combined,” says Tony Biller, managing partner of the Raleigh office of Milwaukee-based Michael Best.
Aside from the DTSA alone, the increase, Biller believes, coincides with the passage of the American Invents Act back in 2011. “It’s been increasingly difficult to assert patent rights in the U.S. as there’s been a fairly broad perception of patent litigation abuse,” says Biller.
