2011 Act 21 was a landmark regulatory reform law. Act 21 clarified the extent of state agency authority by eliminating implied authority and requiring agencies to regulate based on explicit delegations of authority only. Recent litigation, and a formal opinion of the Attorney General have helped clarify what this means for state agencies and Wisconsin’s regulatory environment.
