The Trademark Trial and Appeal Board ("TTAB") provides trademark owners with a court-like administrative proceeding to challenge another party’s right to own a U.S. trademark registration. The U.S. Supreme Court’s March 2015 decision in B&B Hardware, Inc. v. Hargis Industries, Inc. is likely to increase the importance of TTAB proceedings because the Court held that district courts may be bound by TTAB decisions in certain circumstances.
