The Trademark Trial and Appeal Board ("TTAB") provides trademark owners with a court-like administrative proceeding to challenge another party’s right to own a U.S. trademark registration. The U.S. Supreme Court’s March 2015 decision in B&B Hardware, Inc. v. Hargis Industries, Inc. is likely to increase the importance of TTAB proceedings because the Court held that district courts may be bound by TTAB decisions in certain circumstances. Michael Best attorneys Katrina Hull and Lori Meddings will cover the TTAB process, explore the significance of the U.S. Supreme Court decision and discuss strategic considerations for TTAB cases.
