Forty-eight states have adopted the Uniform Trade Secret Act, which provides robust protection of trade secrets. The trick for businesses is to ensure their confidential information will enjoy protection under trade secret law at some uncertain date in the future. Trade secret law requires businesses to take "reasonable" steps to maintain the secrecy of their information, especially in contractual relationships. The challenge is to create language which will trigger trade secret protection but not impair business relationships and contractual functioning. In this webinar, Attorney Eric H.
