Q: What is the most challenging case you have worked on and what made it challenging?
A: A recent case that was very challenging involved an H-1B petition for a security analyst. The beneficiary had a three-year degree in African studies and extensive military experience. It was difficult to obtain a detailed description of the military service. The U.S. Citizenship and Immigration Services challenged us on the specialty occupation classification for a security analyst. We provided expert evidence regarding how the security analyst position is a specialty occupation even though there are very few institutions of higher education that offer bachelor degrees in security management. We were able to piece together an argument regarding how the military service of the beneficiary when combined with his formal education qualified him as having the equivalent of a bachelor's in security management and therefore made him eligible for H-1B status."
