At least one bellwether trial in multidistrict litigation over the opioid crisis is scheduled to start in the third quarter of 2021, with attorneys waiting to see when others will be scheduled after they were put on hold due to the coronavirus pandemic.
Additionally, the U.S. Supreme Court is expected to decide if Ford can be sued for allegedly defective used cars that injured drivers in states outside where they were sold, and attorneys expect "forever" chemical litigation to rise and expand beyond groundwater contamination claims.
"Forever" Toxic Chemicals Litigation Continues
The transition to a Biden presidency may prompt a new wave of lawsuits, as it's expected the new Democratic administration will promulgate new rules on the chemicals, Paul Benson, partner at Michael Best & Friedrich LLP, said.
