“Seventh Circuit arguments over court costs awarded to a wealth management firm that won a trademark case against a similarly named outfit focused almost entirely on jurisdiction Wednesday, with counsel for the losing side insisting that the lower court should have never heard the case to begin with.
Arguments before the three-judge panel were ostensibly about an Illinois federal judge's discretion to award nearly $100,000 in costs to the victor. But the founder of and attorney for Florida-based Ariel Capital Advisors LLC — which was ordered to stop using its name after a bench verdict in favor of Chicago-based Ariel Investments LLC — told the judges that his firm didn't have sufficient contact with Illinois for the lower court to have personal jurisdiction.”
