Partner Marshall J. Schmitt examines a significant case that marks the beginning of a new debate about how to accomplish the purposes of the AIA trial in Intellectual Property Magazine's article, "US patent system at a crossroads."

"On 12 June 2017, in Oil States Energy Services, LLC v Greene’s Energy Group, LLC, the Supreme Court of the US agreed to decide whether the US Constitution empowers Congress to authorise the US Patent and Trademark Office’s (USPTO) Patent Trial and Appeal Board (PTAB) to review the validity of patents in what are known as inter partes reviews (IPRs)."
