How to Have a Successful Wellness Program and Still Comply with the New Rules

An impediment to a truly effective wellness program is uncertainty about compliance with government regulations. Virtually all wellness programs offer rewards or impose penalties, yet the current regulatory environment is so complicated it discourages employers from establishing such incentives. Led by Michael Best attorney Charles P. Stevens, this session will discuss current legal issues employers, health plan administrators and wellness program coordinators face in the interaction between the law and wellness program goals. Topics will include the Affordable Care Act (ACA), the Americans with Disabilities Act (ADA), the Employee Retirement and Income Security Act (ERISA), the Genetic Information Nondiscrimination Act (GINA) and the Health Insurance Portability and Accountability Act (HIPAA). Furthermore, much attention will be paid to the new EEOC regulations and lowering the “ADA risk profile.”
