Update: Why the Recent Proliferation of False Patent Marking Lawsuits?

In an alert that was sent on February 24, 2010, we noted the recent spike in lawsuits for false patent marking under 35 USC § 292. On February 24, 2010, another nine false patent marking lawsuits were filed in the United States District Court for the Northern District of Illinois against Pella, 3M, BP Lubricants, The Quigley Corporation, Irwin Industrial Tool, Edgecraft, Novartis Animal Health US, Novartis Consumer Health, and Monster Cable. Thomsa A. Simonian is the named plaintiff in all nine cases. Mr. Simonian is also the named plaintiff in eleven false patent marking lawsuits filed on February 23, 2010, in the same court against Pfizer, Blistex, CIBA Vision, Bunn-O-Matic, Hunter Fan, Kimberly-Clark, Merial, Mead Westvaco, Weber-Stephen Products, Oreck, and Fiskars Brands.
