It is time to file H-1B petitions for fiscal year 2008, which runs from October 1, 2007 until September 30, 2008. The first date on which new H-1B petitions can be filed is April 1, 2007 for employment beginning October 1, 2007. As there are a limited number of H-1B visas available each year, we suggest that you contact us immediately regarding any “new” H-1B that you will need for the 2007 fiscal year. In most cases, employees who presently have H-1B status, whether with you or another employer, need not worry about the annual cap. Furthermore, the H-1B cap does not apply to employees of colleges and universities. Employees who are on F (student) or J (exchange visitor) status and are using an employment authorization card to work will need “new” H-1Bs and may need immediate attention in order to avoid gaps in employment authorization.
