USEPA Extends Key Compliance Dates for CAFOs

The United States Environmental Protection Agency (USEPA) recently announced that it has extended several important compliance deadlines to July 31, 2007 applicable to Concentrated Animal Feeding Operations (CAFOs).  In a rule effective February 10, 2006, USEPA revised several dates for initial CAFO compliance that it had originally set in its comprehensive CAFO rule issued pursuant to the federal Clean Water Act in 2003.  The rule extends the deadline for all CAFOs covered by the 2003 rule to seek permit coverage and to develop a nutrient management plan from February and December of 2006 respectively until next July.  The extensions were required as USEPA continues to attempt to respond to the court order in the Second Circuit Court of Appeals decision in the Waterkeeper Alliance et al. v.
